The VI Additional District and session court convicted a 44-year-old software engineer who drove his SUV in an inebriated state killing a puncture repairman and injuring two others and damaging four vehicles on December 28,2017.
The court senteneced Kunal Kishore,to under go simple imprisonment of five years and a fine of Rs. 2.5 lakh.
The Judge R Ravindra,directed the authorities to pay compensation of Rs.2 lakh to the deceased family while Rs.25,000 and Rs.10,000 to the injured and the remaining amount to be confiscated to the State.
The convict,Kunal Kishore,native of Bihar and working in the city as a senior software engineer in a reputed IT firm in Electronics City was driving to his apartment from a restaurant.
He was under the influence of alcohol with 385 Mg level more than 10 times of the permissible limits and lost control and run over Dastagir, killing him on the spot,who was repairing a puncture of a scooter outside his shop on the footpath.
The accused also knock down Jeevan Kumar (29) and Rajiv,who are riding near-by and damaged four vehicles parked .
The Electronic city police arrested the accused and seized the car and subjected him for medical examination.
The counsel for the accused submitted that accused is married.Accused has to look after his wife and aged parents.
Further,it is submitted that the accused is working as a software engineer.Hence,he sought the court to take a lenient view and impose lesser punishment.
However Public Prosecutor,KD Suresh submitted that the maximum punishment may be awarded to the accused as the accused drove the car in a drunken condition and caused the accident which resulted in the death of the deceased and caused injuries to two others besides damaging four vehicles .
Mr.Suresh also stated in his argument that wife of the deceased and she lost her husband and had to take care of minor children.
The accident also rendered grievous injuries and simple injuries to two persons.He further submitted that prime objectives of the criminal law is imposition of appropriate,adequate, just and proportionate sentence,commensurate with the nature and gravity of crime and the manner in which the crime is done he said in his statement.
